United States context
The FAA states that a qualifying ultralight vehicle does not require a pilot certificate, but it remains subject to 14 CFR Part 103. The rule is for a single occupant and recreation or sport use, and includes limits on empty weight, maximum level-flight capability, stall speed, operating time, airspace, congestion, visibility, and cloud clearance.
An electric eVTOL is not automatically Part 103 compliant because it has one seat or because software limits speed. The final as-built mass, configuration, performance, use, and operating environment must be reviewed.
